Strategies for Challenging Child Sexual Assault Cases

Child sexual assault cases present particularly difficult cases to challenge, raising multiple issues that overlap. This session will provide an overview of non-DNA issues to consider in investigating whether a child sexual assault might be a wrongful conviction and ways to litigate cases raising those issues. The session will consider child sexual assault medical evidence, child interviewing techniques, recantations and the use of Child Sexual Assault Accommodation Syndrome, ineffective assistance of counsel and prosecutorial misconduct and address how they relate to contribute to a wrongful conviction. For discussion, the session will examine case examples, including that of 2015 exonoree Larry Pohlschneider, to demonstrate.
